Special Education Law

Staples Law provides legal counseling and representation to parents of special needs children seeking free and appropriate education. He has litigated these matters in lawsuits filed in federal court as well as in administrative due process proceedings before the State of New Hampshire Department of Education. He has successfully obtained appropriate individualized education plans and special education placements for students with a variety of disabilities including autism, attention deficit disorder, mental retardation and various specific learning disabilities.

Federal Civil Rights Litigation

For example, Mr. Staples served as lead counsel for students in a federal civil rights lawsuit and successfully challenged a restrictive New Hampshire Department of Education ruling which deprived many disabled children of their right to individualized education plans. Recently, Mr. Staples has successfully defended a number of families against the attempts by school districts to force the institutionalization and residential placement of their disabled children. He has obtained for these children alternative parent-directed and community based programs all at the school district's expense.
